un reading the Supreme Court Vacation Urdinane, No.5
of 1998, I find that section 10 provides that "during vacation,
there shall be at least one Juize in the Colony, and the offices
of the Supreme Court shall be open jally, except on pupilo toll-
days, for such time as the Court may direct".
I do not know if this provision will induce Your sk321-
lency to modify the opinion airealy expressed as to the Chief
Justice's vacation isave: out i submit with respect that in view
of this provision, the case may be thus stated:- "The Chief
Justice may, under the ordinance, be absent from the Cciony dur-
ing the vacation of the Court,and, under the Colonial office
sule 183, is entitled to the same full pay leave as other Civil
servants".
I may add that, in the event of Your excellency not
concurring in this view, I shouli oeg leave to withdraw my
application for leave, cending the decision of the Secretary of
State upon the matter.
